By accessing or using this website (the “Site”), you agree to these Terms of Use (the “Terms”). If you do not agree, please do not use the Site.

2. What we offer

We provide:

  • Coaching services (including menopause coaching, nutrition coaching, lifestyle/positive psychology coaching, spiritual support coaching, and related guidance), and

  • Digital products (downloads, templates, workbooks, guides, courses, programs, and other digital resources).

 

3. Educational content only (not medical or therapy advice)

All content on this Site and in our services/products is for education and general guidance only. It is not medical advice, dietetic advice, psychotherapy, diagnosis, or treatment, and it does not replace care from a qualified professional. If you have symptoms, medical conditions, mental health concerns, are pregnant/breastfeeding, or use medication, consult an appropriate healthcare professional before making changes.

 

4. No guarantees (results vary)

Outcomes vary. Coaching is a collaborative process, and results depend on many factors, including your health, circumstances, consistency, and choices. We do not guarantee any outcome, result, or earnings. You remain responsible for your decisions and actions.

 

5. Eligibility and safe use

  • The Site is intended for users 18+.

  • This Site is not for emergencies. If you need urgent help, contact your local emergency services.

  • We may refuse services if we reasonably believe coaching is not appropriate for your needs and may recommend you seek professional support.

 

6. Acceptable use

You agree not to:

  • Attempt to engage in any unauthorised access, disrupt the Site, probe security, or introduce malware.

  • Copy, scrape, harvest, or commercially exploit content or data without permission.

  • Post or send unlawful, harmful, abusive, defamatory, misleading, or infringing content through forms, comments, or messaging.

We may restrict or terminate access if we reasonably believe you have breached these Terms.

 

7. Intellectual property, images, likeness, and anti-impersonation

Unless stated otherwise, all content on this Site (including text, branding, graphics, downloads, templates, and program materials) is owned by Navigating and Nurturing You Coaching and/or our licensors and is protected by intellectual property and related rights.

 

We use personal images (including photos/videos of our coach/team) for brand identity and educational content. Any misuse of our images or likeness is strictly prohibited, including where used to scam, mislead, or impersonate us. Without our written permission, you may not copy, download, screenshot, edit, repost, distribute, publish, or use any images/videos/branding from this Site for marketing, endorsements, AI training, commercial purposes, or to create derivative works — even if you credit us.

 

You may not:

  • Create fake profiles, pages, ads, websites, WhatsApp numbers, or messages that pretend to be us or imply endorsement.

  • Use our photos/videos (including screenshots), name, voice, logo, or branding to solicit money, personal information, clients, or logins.

  • Edit, manipulate, “deepfake”, or use our likeness in AI-generated content to misrepresent us.

  • Repost our images in a way that confuses the public about who you are or who we are.

Canva + Wix note: Some visuals, templates, icons, fonts, or design elements used on this Site and in our digital products are created using Canva (including Free and/or Pro content) and are used under licence, and this website is built using Wix.

 

Third-party content remains subject to relevant third-party terms/licences. You may not extract, resell, share, or reuse Canva or Wix-provided elements as standalone assets or redistribute editable assets unless you hold your own valid licence that permits that use.

8. Purchases, bookings, cancellations, and refunds

8.1 Pricing, payment, and delivery

  • Prices are in ZAR unless stated otherwise (e.g when converted into your local currency).

  • Payments are processed via third-party providers. We do not store full card details.

  • Digital products are delivered electronically (download link/email/platform access). You are responsible for providing a correct email address and maintaining access to it.

8.2 Coaching sessions (single sessions)

  • Payment: Fees are payable in advance unless we agree otherwise in writing.

  • Rescheduling: You may reschedule with at least 24 hours’ notice (unless your booking confirmation states otherwise).

  • Late cancellation/no-show: Due to the preparation that goes into the coaching sessions prior to the booking, cancellations with less than 24 hours’ notice, or no-shows, will be charged at 100% of the session fee.

8.3 Coaching packages (validity period)

Each coaching package has its own validity period (expiry timeframe), stated on the package sales page, invoice, and/or booking confirmation. You are responsible for reviewing it before purchase.

  • Package sessions must be used within the validity period for that specific package.

  • Any unused sessions expire when the validity period ends and are forfeited (no rollovers), unless we agree otherwise in writing.

  • If you are unsure about the package’s validity period, contact us before purchasing.

8.4 Digital products (downloads/courses/templates)

  • Because digital products are delivered electronically, all digital product sales are final once delivered/access is granted, except where required by applicable law.

  • If a file is corrupted/defective, we will repair, replace, or re-send it.

8.5 Chargebacks and fraud

If a chargeback is raised without first contacting us to resolve the issue, we reserve the right to suspend access to any services/products while the matter is investigated and to provide evidence to the payment provider.

 

9. South African consumer rights

Nothing in these Terms removes rights you may have under applicable South African consumer and e-commerce laws. Where statutory cooling-off/cancellation rights apply to a specific transaction, they apply regardless of any policy wording here.

 

10. Testimonials and examples

Testimonials, reviews, and examples reflect individual experiences and are not promises of results. Outcomes vary and are dependent on the clients commitment and health condition.

 

11. Third-party links and tools

The Site may include links to third-party websites/tools (including booking and payment providers). We do not control third-party sites and are not responsible for their content, availability, or privacy practices. Use them at your own risk.

 

12. Privacy and POPIA

We process personal information in line with our Privacy Policy and applicable data protection laws, including POPIA.

 

Important: Email and WhatsApp are not guaranteed secure channels. Avoid sending highly sensitive medical information via WhatsApp.

 

13. Communications (WhatsApp, email, online video conference platforms and Zoom)

By using this Site, submitting a form, subscribing, purchasing a product, or booking a service, you consent to communicate with us via:

  • Email (for confirmations, receipts, resources, support, and admin),

  • WhatsApp (for scheduling, reminders, check-ins, support messages, and admin), and

  • Zoom (for coaching sessions and online meetings, where applicable).

If you do not agree to communicate via these channels, please do not use the Site or book services.

 

Zoom/online video conferencing platform sessions: Where sessions are delivered via these video conference platforms, you are responsible for having the required device, internet access, and ability to join video conference platform meetings. The video conference platforms are third-party service with its own terms and privacy practices, and we are not responsible for video conference platforms outages or technical failures outside our control.

 

Privacy note: Email and WhatsApp are not guaranteed secure channels. Please avoid sending highly sensitive medical information via WhatsApp.

 

Marketing: If we send marketing messages, you will have an option to opt out where required..

 

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss arising from your use of the Site, reliance on content, or participation in coaching/programs. The Site and content are provided on an “as is” basis. This clause does not exclude liability that cannot legally be excluded.

 

15. Indemnity

You agree to indemnify and hold us harmless from claims, losses, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site, breach of these Terms, or violation of any law or third-party rights.

 

16. Suspension and termination

We may suspend or terminate access to the Site or our services/products if we reasonably believe you have breached these Terms, engaged in harassment/abuse, or used our content/images/brand unlawfully.

 

17. Changes to these Terms

We may update these Terms from time to time. The latest version will be posted on this page with the updated date. Continued use of the Site means you accept the updated Terms.

 

18. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa, and disputes will be subject to South African courts (unless mandatory consumer protections apply otherwise).

 

19. General

  • Severability: If any part of these Terms is unlawful or unenforceable, the rest remains in effect.

  • No waiver: If we do not enforce a right immediately, we do not waive that right.

  • Assignment: You may not transfer your rights under these Terms without our written permission.
